Normally I would like to add my own comments, but she covers it so well that all I can do is give my utmost respect.  I highly encourage the readers to go to the link to read her entire piece, but I just have to reproduce the Grand Finale here so that you can know what a treat you are in for.  The entire quote from Groklaw is in italics, PJ&#8217;s comments are in bold.</p>
<p><em> <strong>What about trademarks? Psystar keeps those all for itself, revealing themselves as lovers of IP rights in all their forms, so long as Psystar is the beneficiary:</strong></p>

<p><strong>So, let me get this straight. They can sell stuff using Apple&#8217;s trademarks, and yours, but woe betide us if we use Psystar&#8217;s? Anybody note an imbalance in the universe here? But I saved the best for last:</strong></p>
<p>11. Ownership. Subject to the licenses granted under this License, each Contributor retains all rights, title and interest in and to any Modifications made by such Contributor. Psystar retains all rights, title and interest in and to the Original Code and any Modifications made by or on behalf of Psystar (&#8221;Psystar Modifications&#8221;), and such Psystar Modifications will not be automatically subject to this License. Psystar may, at its sole discretion, choose to license such Psystar Modifications under this License, or on different terms from those contained in this License or may choose not to license them at all&#8230;. </p>
<p><strong>Well, well. You gave them rights, but when it&#8217;s their turn, it&#8217;s maybe they will, and maybe they won&#8217;t. They might not license their stuff at all? And *Apple* is a meanie because it has license terms? Puh lease.</strong><br />

And one last cherry on top, Exhibit A, includes this term:</strong></p>

You have to comply with Psystar&#8217;s license or you can&#8217;t use the code, even if you didn&#8217;t say I agree? Well, I declare.</p>
<p>Psystar is promoting Open Source &#8220;in every way possible?&#8221; That&#8217;s what they told us [Google the license by name], before they revamped their web site.</p>
<p>And Psystar is fighting to prove EULAs are from the devil?</p>
<p>I think not, m&#8217;lords</strong>. </em></p>
<p>That flushing sound you hear is any last remaining vestige of Psystar&#8217;s credibility going down the toilet, at least in this writer&#8217;s personal opinion.  Actually, after reviewing the <a href="http://psystar.com/opensource/ppl/" target="_blank">actual license</a> myself as well, I do have some comments.  Notice this little requirement:</p>
<p><em>13.6 Dispute Resolution. Any litigation or other dispute resolution between You and Psystar relating to this License shall take place in the Northern District of California, and You and Psystar hereby consent to the personal jurisdiction of, and venue in, the state and federal courts within that District with respect to this License. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.</em></p>
<p>So this Champion of the Underdog, whose principal place of business is in Florida, and whose customers can be anywhere, will require all dispute resolution to take place clear across the country?  I think perhaps they might want to amend that seeing how things aren&#8217;t going so well for them in the Northern District at this time.</p>

			<content:encoded><![CDATA[<p>According to a <a href="http://www.macworld.com/article/137317/2008/12/iphonemarketshare.html?lsrc=rss_main">new report from Gartner</a> the iPhone has showed a 327.5 percent market share increase in worldwide smartphone sales for the third-quarter of 2008.</p>
<p>Apple&#8217;s iPhone grew it&#8217;s market share from 3.4 percent in quarter 3 of 2007 to 12.9 in the same quarter of 2008. The rise puts Apple in third place behind Nokia and RIM in the smartphone market.</p>
<p>Those figures represent worldwide market share but when looking at North America alone Apple holds second place behind RIM with 25.4 percent of the smartphone market. The same goes for Europe where Apple is in second place behind Nokia with 15.6 percent market share.</p>
<p>In Gartner&#8217;s report analyst Roberta Cozza noted that economic issues around the world had slowed smartphone sales adding that iPhone sales exceeded sales of Microsoft Windows Mobile devices worldwide.</p>

Back in October <a href="http://news.worldofapple.com/archives/2008/10/13/wal-mart-to-carry-iphone/"><i>Boy Genius Report</i> reported</a> that the iPhone would be coming to Wal-Mart soon, but to this day that has yet to happen. <a href="http://www.macrumors.com/2008/12/04/wal-mart-to-sell-99-4gb-iphone/">According to Mac Rumors</a> the official release is pinned for December 28th and Wal-Mart staff have already begun receiving training.</p>
<p>Today Boy Genius Report is <a href="http://www.boygeniusreport.com/2008/12/04/apple-to-sell-a-99-4gb-iphone-at-walmart/">also claiming</a> that Apple will reintroduce the 4GB iPhone and it will be sold for $99 with a two year contract. BGR does warn that it is not 100% confident about the report so it should be taken with a grain of salt.</p>

<p>Setting Up Exchange</p>
<p>Mail includes an autodiscovery feature to streamline the configuration process:<br />
1. Open Mail preferences and click the plus button to add a new account<br />
2. Enter your Microsoft Exchange email address and password and click &#8220;Continue&#8221;*<br />
3. Your server settings will be auto populated and you can choose to simultaneously configure Exchange for Address Book and iCal as well<br />
4. Verify the settings are correct and click &#8220;Create&#8221;</p>
<p>If your server settings are not automatically configured, after step 2 you can select &#8220;Microsoft Exchange 2007&#8243; as a new account type and manually enter your server settings.</p>

<li> Messages moved from a different account to Exchange no longer have content replaced with &#8220;=&#8221; characters

<li> Editing existing contacts doesn&#8217;t always work as expected.

<li> Displaying and editing photos for Exchange contacts is not fully supported.
<li> Error messages may be unhelpful or non-existent. *e.g. There is no warning if you enter the incorrect password.
<p>Multicore
<li> Grand Central<br />
Dispatch Group [New]<br />
A Dispatch Group API has been introduced, allowing applications to group multiple Blocks together and wait for their completion or receive an asynchronous notification of their completion. *See the dispatch_group(3) manual page for more information.</p>
<p>Retain / Release<br />
GCD has been changed to provide polymorphic data types. *As a result, all GCD data types can now be retained and released via a single API pair: dispatch_retain() and dispatch_release()</p>
<p>dispatch_apply()<br />
The dispatch_apply() function&#8217;s arguments have changed order for consistency with other GCD APIthe Queue argument now immediately precedes the Block argument.</p>
<p>dispatch_source_signal_create()<br />
The dispatch_source_signal_create() function has changed to accept an integer signal number instead of a sigset_t.</p>
<p>64-bit Kernel<br />
64-bit kernel development is supported on the following systems:<br />
 Mac Pro (Early 2008) [MacPro3,1]<br />
 iMac 20&#8243; and 24&#8243; (Early 2008) [iMac8,1]<br />
 MacBook Pro 15&#8243; and 17&#8243; (Early 2008) [MacBookPro4,1]<br />
 Xserve (Early 2008) [Xserve2,1]</p>
<p>The MacBook Pro (Late 2008) [MacBookPro5,1] is not currently supported for 64-bit kernel development.</p>
<p>Systems can be booted into the 64-bit kernel in one of two ways:<br />
1) To temporarily boot into the 64-bit kernel, hold down &#8220;6&#8243; and &#8220;4&#8243; while powering on the machine<br />
2) Run `sudo nvram boot-args=&#8221;arch=x86_64&#8243; ` to set the 64-bit kernel as your default kernel, and append any other<br />
debugging ﬂags you may need, such as &#8220;debug=0&#215;144&#8243;. To revert back to the 32-bit kernel as the default, you can run<br />
`sudo nvram -d boot-args`.</p>
<p>The 64-bit kernel is used by default on Mac OS X Server on the Mac Pro (Early 2008) and Xserve (Early 2008). The 32-bit kernel can by used by either holding down &#8220;3&#8243; and &#8220;2&#8243;, or running `sudo nvram boot-args=&#8221;arch=i386&#8243; `</p>

<p>Other Areas</p>
<li> Directory Utility support for updating directory server information has moved into the Login Options section of the Accounts Preference Pane
<li> The spell-checking language can now be specified in the International Preference Pane
<li> Improved calendar support for Thailand and Ethiopia, and general enhancements
<li> There have been some broad changes in how widgets are rendered, please report any anomalies
<p><Strong>Known Limitations</strong></p>
<p>Installation Issues</p>
<ul>
<li> Upgrades are only supported from 10.5.5+ and the previous Snow Leopard seed (build 10A190).
<li> Portables must be plugged into a power source to install Snow Leopard.
<li> It may take several minutes for all of the disks to become available in the Mac OS X Installer.
<li> Selecting an installation volume while some volumes are still grayed out may result in a hang.
<li> When installing from the Mac OS X Installation DVD, the system may sit at a grey screen with the Apple logo for up to ten minutes before progressing.
<li> There are intermitting hangs that may prevent the Mac OS X Installer from completing. If the progress bar has not moved for over 20 minutes please re-attempt your installation.
<li> Users who hang at a grey screen after installation should reboot once into &#8220;safe boot&#8221; mode by holding down the shift key when powering on the machine. Subsequent normal boots should be ok.
<li> Some users have reported that the screen is very dim during the when installing Mac OS X. Re-attempting the install will typically result in a fully lit screen.
<li> &#8220;Install Mac OS X.app&#8221; will not launch on Tiger. Users wishing to upgrade from Tiger should boot into the Snow Leopard Installation DVD by holding down the &#8216;c&#8217; key with the DVD in the drive when booting.
<li> When migrating your users and applications from another system after installation, the progress indicator may report completion and stop well before migration actually finishes. When migration does complete, the next MacBuddy panel will appear normally.
</li>
</ul>
<p>Time Machine Network Backup Issues<br />
If your Time Capsule Base Station name, backup volume name or user name contains a space, backups to Time Capsule or network backup destinations will not complete. Please follow these steps to work around this issue:</p>
<p>1. Remove any spaces from your user name</p>
<ul>
<li> Open System Preferences and choose the Accounts preference pane
<li> Edit the &#8220;Name&#8221; to not contain any spaces
<li> Reboot
</li>
</ul>
<p>2a. If using Time Capsule backups</p>
<ul>
<li> Open AirPort Utility and choose your Time Capsule
<li> Click the Manual Setup button
<li> Choose the Airport section from the toolbar, then choose the Time Capsule tab and ensure that Time Capsule Name does not contain any spaces
<li> Choose the Disks section from the toolbar, then choose the Disks Tab then select the volume on the disk and ensure that its Name field does not contain any spaces
<li> Choose Update and let the Time Capsule restart
</li>
</ul>
<p>2b. If using AFP network backups</p>
<ul>
<li> Login to the host machine for your network backups
<li> Change the backup volume name so that it does not contain any spaces
<li> Open System*Preferences to the Sharing preference pane*and verify that the machine name does not contain any spaces
<li> Open System Preferences to the Accounts preference pane and verify that the name of the account you will be using to connect does not contain any spaces
</li>
</ul>
<p>3. Re-configure Time Machine destination</p>
<ul>
<li> Open System Preferences and select the Time Machine pane
<li> Click Select Disk and choose the network backup volume
<li> Enter your username/password*
</li>
</ul>
<p>Other Issues</p>
<ul>
<li> asr will fail when specifying a volume name as the target. Unmount the volume and specify the /dev entry to workaround.
<li> Launching PhotoBooth or attempting to use iChat video effects with the latest MacBooks and MacBook Pros will leave your system in an unusable state that requires a reboot to resolve.
<li> The Mobile Me Preference Pane may report that a sync is in progress even when it is actually complete.
<li> Some checkboxes for selecting what data to sync in the Mobile Me Preference Pane may not be clickable until quitting and relaunching the Preference Pane.
<li> iDisks may not mount correctly in Finder. In Finder&#8217;s &#8216;Go&#8217; menu select &#8216;iDisk&#8217; and &#8216;Other User&#8217;s iDisk&#8217; to workaround
<li> Enabling iDisk syncing may cause FileSyncAgent to crash.
<li> Time Machine will encounter errors when backing up to a network volume if the volume name or the admin user&#8217;s name includes spaces. To work around this issue, rename the Time Machine volume or set up Time Machine from an admin user whose user name is only one word.
<li> First generation MacBook Air&#8217;s may exhibit*occasional*graphics corruption. Sleeping and waking the machine or reboot typically works around this.
<li> Attempting to configure Hot Corners in the &#8216;Display &#038; Screen Savers&#8217; Preference Pane or going to the Advanced section of the Network Preference Pane on a Mac Pro while running with a 64-bit kernel will result in a kernel panic.
<li> On some systems with NVIDIA graphics cards DVD movie playback will only be visible when a second monitor is attached.
<li> Layered graphics do not render correctly in Safari.
<li> Audio / Video chats in iChat may not always connect successfully.
<li> Airport connections secured with 802.1X may be unreliable.
<li> Open, Review &#038; Show Info Finder services are not functioning.*
<li> Ink is not functioning in this seed.*<br />
-*Lexmark printer drivers are not*available*at this time.</p>
<li> SMB printing is not working in this seed.
<li> Fax support is not working in this seed.
<li> Portables may experienced decrease battery life.
</li>
</ul>
<p>Developer Issues</p>
<ul>
<li> gcc will output 64-bit binaries by default when building on a 32-bit system. Specify the correct architecture with the &#8216;-arch&#8217; flag to workaround. You can also add &#8220;-arch i386&#8243; to your CFLAGS environment variables when building software with Makefiles or autoconf scripts.
<li> 32-bit contextual menu plugins will not work in 64-bit apps.
<li> gdb must be run as root when debugging Power PC applications.
<li> To compile for PowerPC architectures it is necessary to link against the Mac OS X 10.5 SDK.
<li> Running &#8217;sample&#8217; generates extra warnings.<br />
-*The legacy database establishing code equivalence between different versions of a program that is not code-signed has been removed. This will result in additional dialogs when a non-code-signed third-party program attempts to access another non-code-signed program.</p>
<li> The WebObjects developer support package is not included in the Xcode Tools distributed with this seed of Snow Leopard. The package may be downloaded from ADC soon after the Snow Leopard seed has been made available.
<li> Some Carbon applications might find that Carbon event handlers are not firing, or are incorrectly fired at earlier or later times during application initialization.
<li> Kexts calling sysctlbyname() may panic in that call.
</li>
</ul>
<p>Xcode</p>
<ul>
<li> Xcode, when run on 32-bit systems, will hang when refactoring more than 2 or 3 files at once.
<li> When running 64-bit apps in Xcode, breakpoints are not set when breakpoints are activated and the backtrace is incomprehensible then the program is paused. To workaround this, activate breakpoints before running your application or to choose Run > Debug to force debugging.
<li> Within the debugger, NSString values are not visible in the Summary column.
<li> Referring to an .xcconfig file using #include does not consult any of the targets Search Paths; all referenced configuration files should be stored in the same directory.
<li> Using a port number when setting up a Subversion repository in the Repositories panel generates an inaccurate svn+ssh: URL. Instead of entering the port number in the Repository setup pane, eave off the port number in Xcode and add an entry with the port number in ~/.ssh/config for the desired host.
<li> A bug in NSFileManager makes restoring from snapshots fail catastrophically in specific circumstances. Until this is addressed, ensure that you have a Time Machine backup or a repository version of your working code before attempting to restore from a snapshot.
<li> When adding frameworks or libraries using the Target Inspector, you can only see frameworks in the SDK that the inspected target is configured for. To add frameworks from a different SDK, first change the Base SDK setting of that target.
<li> Find in File and Project Find will only find the actual key names in a Property List file, not the display names as seen in the Property List Editor. 5946354 Replace does not work in the embedded Property List editor; command-click and choose Open As [▶] Source Code File to perform Find and Replace.
<li> Syntax-Aware Indentation does not work correctly with certain keyboard layouts, such as German.
<li> The default Build and Go toolbar item is not useful in projects without a configured Executable, such as KEXT projects. Add a Custom Executable or replace the Build and Go item with Build.
<li> When running 64-bit apps in Xcode, breakpoints are not set when breakpoints are activated and the backtrace is incomprehensible then the program is paused. To workaround this, activate breakpoints before running your application or to choose Run > Debug to force debugging.

<p>Interface Builder</p>
<ul>
<li> Interface Builder has deprecated the Apple Script Studio inspector and now automatically upgrades NIB files to the 3.x format when NIB files are saved. These two capabilities can be reenabled with the following user defaults commands:

<p>64-bit kernel</p>
<ul>
<li> Shark does not work on the 64-bit kernel.
<li> Sleep / wake and power management is not currently supported. It is recommend that you disable sleep in System Preferences.
<li> Graphics acceleration is not yet supported which may cause programs which require graphics acceleration to run incorrectly.
<li> Some behavior which was previously unsupported, such as modifying a collection while enumerating it, and attempting to modify a kext&#8217;s __TEXT segment, now results in diagnostic kernel panics.
</li>
</ul>
<p>Font System</p>
<ul>
<li> Applications that register fonts using ATS APIs will not be visible to NSFont or CTFont APIs. For example, the Instruments application in Developer /Applications uses a font whose number glyphs like a digital calculator numbers. You will notice that these font is missing and the numbers are displayed using Helvetica.
<li> CTFontManager APIs are functional. These are the replacement APIs for the ATS font registration APIs. Currently, fonts registered with these APIs are only available to clients of CoreGraphics, CoreText, and Cocoa. ATS APIs will not see these fonts.
<li> The system includes a new system font for Simplified Chinese (STHeitiSC-Light) and Traditional Chinese (STHeitiTC-Light). If your application hard codes the use of STXihei and LiHeiPro, these are the replacements for Snow Leopard.
<li> Font Book is being re-written, but is not yet fulling functional
<li> Third party Font Management utilities (Suitcase, FontAgent Pro, LinoType Explorer, etc.) are only partially functional.
<li> Font installation should be done using the Finder. Drop your fonts into any of the known Font folders to install.
<li> Legacy font formats are not fully supported in the seed. Please report any fonts that don&#8217;t work for you.
<li> SFNT CID fonts do not fully work (e.g. PDF).*
<li> Variations/MM fonts are not functional and may display incorrectly.
<li> Please report any issues with front rendering, particularly in PDFs. Where possible, include the PDF.
</li>
</ul>
<p>Third Party Issues</p>
<ul>
<li> TextMate may crash for some users.
<li> The Microsoft Office 2004 Installer does not work on this seed. *Drag the Office 2004 folder from the installation Image onto your local system to workaround.
<li> Unplugging a Motorola USB modem may lead to a panic.
<li> Some users may experience panics when using Cisco VPNs.
<li> Some third party installation packages may run into errors when running scripts.

<p><i>&#8220;We have removed the KnowledgeBase article because it was old and inaccurate,&#8221; Apple spokesman Bill Evans, told Macworld. &#8220;The Mac is designed with built-in technologies that provide protection against malicious software and security threats right out of the box.”</i></p>
<p>The support page was criticised by many as it went against Apple&#8217;s latest &#8220;Get a Mac&#8221; adverts which ridiculed Windows users for having to invest in anti-virus solutions to protect their computers.</p>

			<content:encoded><![CDATA[<p>When news broke of Apple advising Mac owners to go out an buy an anti-virus solution I personally shrugged it off, I&#8217;d seen this kind of advice from Apple before and viewed as nothing more than a command sent down from the legal department. Similar to Apple offering and advising you to use AppleCare hardware.</p>
<p>The problem is, as with many of these types of stories. Those who decided to write it up have done so without proper research and have caused a cascade of misinformation; to the point where the BBC is <a href="http://news.bbc.co.uk/1/hi/technology/7760344.stm">writing up the &#8220;news&#8221;</a> which quickly became one of the most viewed stories on the site and remains as of writing the most emailed.</p>
<p>Thankfully <a href="http://www.tuaw.com/2008/12/02/apple-updates-antivirus-version-numbers-security-savants-lose-g/">one blogger</a> has done the hard work that everyone else should have done and pointed out that the support technote that Apple <a href="http://support.apple.com/kb/HT2550?viewlocale=en_US">posted on November 21</a> (updated December 2) was in fact an amended article which was <a href="http://web.archive.org/web/20080113164722/http://docs.info.apple.com/article.html%3Fartnum%3D4454leanupdata.com/">originally posted on Apple&#8217;s site</a> in June 2007.</p>
<p>So Apple has been offering this recommendation for 18 or so months although even Apple claims that the article &#8220;does not constitute Apple’s recommendation or endorsement&#8221; but is only their for &#8220;information purposes&#8221;.</p>
<p>And before everyone jumps on my back I do see the importance of running anti-virus software in networked environments where Windows PCs are present and maybe even as just a precaution on your Mac, but you won&#8217;t catch me running one of these bloated third-party anti-virus applications.</p>

<p>Since that time, on October 10, 2008, Apple moved to Dismiss Plaintiffs&#8217; Amended Complaint for Failure to State a Claim.  Basically, Apple alleges that the Plaintiffs failed to comply with a necessary condition precedent to bringing a lawsuit on the alleged grounds under Alabama law: they failed to contact Apple to allow Apple the chance to repair or replace the iPhones if necessary.  Apple also alleges that a case for unjust enrichment is barred under the terms of its One Year Warranty.</p>
<p>The Plaintiffs responded on October 21, 2008, relying heavily on the much-publicized problems that some users were having with their devices resulting in Apple already providing multiple corrective updates and that Apple and/or its distributors leaked information that additional corrective updates were forthcoming which would remedy the problems in full. Thus, they claim that Apple had sufficient notice to satisfy the spirit of the Alabama requirement.  They further claim that they cannot be denied unjust enrichment relief as they were unaware of the One Year Warranty and its terms.</p>
<p>On October 24, 2008, the Court noted that the parties are in dispute as to the existence and/or knowledge of this warranty and gave the parties seven days to attempt to come to an agreement on that issue.  If the parties could not agree, the Court stated that it would rule upon Apple&#8217;s Motion without assuming the existence and/or delivery of the alleged warranty.</p>
<p>On November 4, 2008, the Court issued its Opinion and Order as two separate filings.  The Court&#8217;s Opinion noted that the existence and/or delivery of the warranty remains a contested issue.  The Court granted Apple&#8217;s Motion to Dismiss as to the warranty claims and denied the Motion as to the unjust enrichment claim.  While this  may seem confusing, the granted portion was based not upon the existence of the disputed warranty issued by Apple but upon the Alabama Commercial Code which legislates that providing actual notice is an absolute condition precedent to any claim of breach of warranty.  The Court noted that the Code provides that the seller must be notified within a reasonable amount of time after discovery of the problem or else <strong>be barred from any remedy.</strong> [emphasis in original]  The Court rejected the Plaintiffs&#8217; argument of general notice and opined in some detail as to its reasoning that notice was required as to these specific devices purchased by these specific people.</p>
<p>In its separate Order of the same date, Counts I and II of the Plaintiff&#8217;s complaints were officially dismissed with prejudice (meaning that they are adjudicated in finality, unless appealed, if possible) and that the Plaintiffs&#8217; claim of unjust enrichment remained as there were factual disputes between the parties as to the existence and/or delivery of the alleged One Year Warranty provided by Apple.  The Court noted that this dismissal with prejudice does not affect the rights of any members of the putative class.</p>
<p>On November 19, 2008, Apple responded to the remaining claim and various factual allegations in the Plaintiffs&#8217; Amended Complaint.  The crux of Apple&#8217;s Answer is its denial that the iPhone 3G is defective.  As far as the request for class-action status, Apple denied that class treatment is warranted in this instance and that any members of this purported class have not been damaged or entitled to relief.  Apple repeated its assertion of the existence of its One Year Warranty which would bar the claim of unjust enrichment.  Apple also asserted nineteen affirmative defenses.  At first, I was going to repeat them all here but decided to wait for reader input as I am learning that not all tech geeks are also legal geeks who like to read court filings for fun.  Let me know if those additional details are something you would be interested in.</p>
<p>The last filing was entered on November 20, 2008 and comprised an Order from Judge Acker reminding the parties of certain local rules and asking for notification if this case should be evaluated for ADR (alternative dispute resolution).</p>

			<content:encoded><![CDATA[<p>Piper Jaffray analyst Gene Munster has <a href="http://apple20.blogs.fortune.cnn.com/2008/12/01/black-friday-13-macs-per-hour/">posted the results</a> of his teams 10-hour research which saw them counting Mac and iPhone sales in five Apple Stores in the United States on Black Friday.</p>
<p>In his research Munster noted that Apple was offering discounts on seven products and those discounts averaged 8%. Mac Sales averaged 13 sales per hour, up from 2 per hour earlier in November. iPhone sales averaged 3.4 per hour up from 1.3 earlier in the month.</p>
<p>Munster concluded that Macs are selling better than expected and iPhones are in line with expectations.</p>
<p>Also in his report Munster explains how he can maintain a target on AAPL of $250 a share. Munster writes that his target is based on 20 times earnings and is using Apple&#8217;s non-GAAP earnings which included revenue from the iPhone.</p>

			<content:encoded><![CDATA[<p>In a <em>very interesting</em> turn of events, on November 26, 2008, Apple filed a Notice of Motion and Motion for Leave to File Amended Complaint stating in part:</p>
<p><em>&#8220;Through this motion, Apple seeks leave to file its Amended Complaint &#8230; attached hereto as Exhibit A, adds a Digital Millennium Copyright Act claim, additional factual allegations related to Apple&#8217;s previously asserted claims and Doe defendants.  The DMCA claim is based on new information that Apple has learned since the filing of its original complaint.  Apple&#8217;s Amended Complaint is timely, does not cause any prejudice to Psystar and should be permitted.&#8221;</em></p>
<p>So what does this possibly mean?  It <em>could</em> be confirmation of <a href="http://www.idrankthekoolaid.com/?p=586" target=_blank">my long-standing theory </a>that the Psystar principals are merely patsies for some larger interests who wish to be spared the publicity of going against Apple but would benefit from a victory in this case.  Under my theory those interests would be the as-yet unidentified &#8220;Does 1&ndash;10&#8243; that Apple wishes to add as co-defendants.  The plot thickens indeed.</p>
<p>It is likely that the Court will grant this motion.  The parties themselves had already previously agreed to a date of January 19, 2008 to amend the pleadings.  Psystar has indicated to Apple&#8217;s counsel that it opposes this filing.</p>
<p>I note that the proposed Amended Complaint is six pages longer than the initial Complaint.  I have verified that this addition is not comprised by exhibits but rather the Complaint itself.</p>
<h3>Doe Defendants 1&ndash;10</h3>
<p>The Amended Complaint reveals tantalizingly little about these unidentified parties.  Here is the extent of the information pled:</p>
<p><em>18.  On information and belief, persons other than Psystar are involved in Psystar&#8217;s unlawful and improper activites described in this Amended Complaint.  The true names or capacities, whether individual, corporate, or otherwise, of these persons are unknown to Apple.  Consequently they are referred to herein as John Does 1 through 10 (collectively the &#8220;John Doe Defendants&#8221;).  On information and belief, the John Doe Defendants are various individuals and/or corporations who have infringed Apple&#8217;s intellectual property rights, breached or induced the breach of Apple&#8217;s license agreements and violated state and common law unfair competition laws.  Apple will seek leave to amend this complaint to show the unknown John Doe Defendants&#8217; true name and capacities when they are ascertained.</em></p>
<p>If I am right, some backers of Psystar are sweating right now, and if they are paying the bills, I would not be surprised to see some push for a nominal settlement. <h3>Additional Allegations in Amended Complaint</h3>
<p>Paragraph 12 is expanded to include Psystar&#8217;s OpenPro, and Psystar&#8217;s practice of offering Leopard updates at its site that are either exact copies or modified versions of Apple&#8217;s copyrighted software.  From this point on, the paragraph numbers do not match as Apple has added two additional paragraphs prior to the paragraph previously numbered as 14 and later moves around and adds other paragraphs.  These first additional paragraphs mention Psystar&#8217;s plans to release additional computers using unauthorized copies of Leopard, including laptops, as well as Psystar&#8217;s practice of distributing a restore disk and providing support for customers to install Mac OS X software in an unauthorized manner.</p>
<p>In its General Allegations, Apple quotes more extensively from the EULA including the Transfer and Termination provisions. In the First Claim for Relief, allegations of additional copyright infringement, including unauthorized derivative works, are added.  The Third Claim for Relief points out that Apple had taken measures to protect their copyright, and the defendant has illegally circumvented these measures.  The Fourth Claim for Relief sets forth with more specificity Psystar&#8217;s alleged infringements.  The Fifth Claim for Relief includes a new allegation that Psystar has admitted it was aware of the existence of the EULA.  The Seventh Claim for Relief contains additional information on Psystar&#8217;s alleged harm to Apple&#8217;s trade dress and reputation. In the Eighth Claim for Relief, as in earlier claims not here noted, Apple makes a specific allegation that Apple&#8217;s Trade Dress is non-functional.  The import of that allegation is beyond my ken.  An Eleventh Claim for Relief was added alleging violations of Common Law Unfair Competition.</p>
<p>Many of the allegations contain strengthened wording of <em>&#8220;intentional, willful and in conscious disregard of Apple&#8217;s rights.&#8221;</em></p>
<p>Apple&#8217;s Prayer for Relief contains a request for a preliminary injunction which was noticeably absent from the first Complaint which only sought a permanent injunction.  It is my opinion that the Court may very well grant a preliminary injunction until the case is resolved.  Apple can easily argue that Psystar&#8217;s business does not solely rely upon its disputed sales of non-Apple hardware loaded with OS X as Psystar also sells computers loaded with Windows and Linux.</p>
<p>The above listing of changes is not intended to be all-encompassing.  It is the product of my first review of the documents for the most important highlights.  As I have time to examine the filings more closely, I will provide additional information.  I remind the reader that my opinions are lay-opinions as I am not an attorney, and if authoritative opinions are desired, a competent licensed attorney should be consulted.</p>

			<content:encoded><![CDATA[<p>The British TV Advertising Standards Authority has for a <a href="http://news.worldofapple.com/archives/2008/08/27/uk-iphone-advert-labelled-misleading/">second time</a> forced Apple to stop showing an iPhone advert labelling it as misleading.</p>
<p>The advert which shows an iPhone 3G accessing information on the internet &#8220;really fast&#8221; <a href="http://www.asa.org.uk/asa/adjudications/Public/TF_ADJ_45381.htm">received 17 complaints</a> from the public who stated that the &#8220;ad was misleading, because they believed it exaggerated the speed of the iPhone 3G.&#8221;</p>
<p>In a response Apple claims that the &#8220;opening line of the voice-over stated &#8220;So what&#8217;s great about 3G?&#8221;. They believed that the claim clearly positioned the content of the ad as a comparison of the new 3G iPhone with its 2G predecessor.&#8221;</p>
<p>Adding that &#8220;the implication that the 3G iPhone allowed downloads and internet access that was &#8216;really fast&#8217; by comparison to the previous generation was not misleading.&#8221;</p>
<p>In addition to Apple&#8217;s response Clearcast also defended the ad saying that &#8220;they received supporting evidence for the claim and were satisfied that the 3G iPhone could achieve speeds that, when compared to the rest of the market, were reasonably fast.&#8221;</p>
<p>The ASA ruled that the ad &#8220;must not appear again in its current form&#8221; after deciding that the ads &#8220;repeated use of the claim &#8220;really fast&#8221;, were likely to lead viewers to believe that the device actually operated at or near to the speeds shown in the ad.&#8221;</p>

			<content:encoded><![CDATA[<p>In new court documents only revealed this week it is shown that a federal judge ordered Mark Papermaster to <a href="http://news.worldofapple.com/archives/2008/11/10/papermaster-ordered-to-halt-apple-employment/">halt work at Apple</a> because he could cause &#8220;irreparable harm&#8221; to former employer IBM.</p>
<p>Although the ruling was made by Judge Kenneth Karas on November 7 the decision was only made <a href="http://www.macworld.com/article/137141/2008/11/papermaster_ibm.html?lsrc=rss_main">public earlier this week</a>.</p>
<p>In the ruling Judge Karas wrote &#8220;Because Mr. Papermaster has been inculcated with some of IBM&#8217;s most sensitive and closely-guarded technical and strategic secrets, it is no great leap for the Court to find that Plaintiff has met its burden of showing a likelihood of irreparable harm.&#8221;</p>
<p>The judge also touched on Papermaster&#8217;s point that Apple and IBM <a href="http://news.worldofapple.com/archives/2008/11/22/ibm-ponies-up-a-cool-3-million-dollars-to-keep-the-papermaster-injunction-in-place/">are no longer competitors</a>, Karas noted that although Papermaster would not be designing chips for Apple he would no doubt have to call upon is superior experience that he received from IBM.</p>
<p><i>&#8220;It is likely that Mr. Papermaster inevitably will draw upon his experience and expertise in microprocessors and the &#8216;Power&#8217; architecture, which he gained from his many years at IBM, and which Apple found so impressive, to make sure that the iPod and iPhone are fitted with the best possible microprocessor technology and at a lower cost,&#8221;</i> adding; <i>&#8220;Indeed, any claim that he would merely use general engineering skills is belied by Apple&#8217;s focus on Mr. Papermaster&#8217;s &#8217;spot on&#8217; knowledge of semiconductors and microprocessor design,&#8221; he added.</i></p>
<p>Karas ruled that the case would run on a fast track, &#8220;The Court has ordered that an expedited discovery schedule be arranged and that the trial take place as soon as practicable after discovery is completed,&#8221; he said.</p>

			<content:encoded><![CDATA[<p>On Tuesday night Apple released an update to QuickTime which fixes a controversial issue affecting the new MacBook, second generation MacBook Air and MacBook Pro notebooks.</p>
<p>The complaint from users of the new notebooks was that standard definition movies purchased from the iTunes store would not playback on an external display due to <a href="http://en.wikipedia.org/wiki/HDCP">HDCP</a> restrictions.</p>
<p>Apple writes the following about the update:</p>
<p><i>This update is recommended for owners of MacBook, MacBook Air, and MacBook Pro with Mini DisplayPort. The update addresses an issue where some standard definition purchases from the iTunes Store do not play on some external displays.</i></p>
<p>The update means that content purchased from the iTunes store should now playback with no issues.</p>

			<content:encoded><![CDATA[<p>According to a <a href="http://news.bbc.co.uk/2/hi/entertainment/7747491.stm">report from the BBC today</a> Beatles guitarist Sir Paul McCartney  is keen to see The Beatles make an appearance on the iTunes Store but former &#8220;heavy negotiations&#8221; between Apple Corps and former record label EMI have since &#8220;stalled.&#8221;</p>
<p>The BBC writes that EMI still owns rights to the Beatles back catalogue and therefore must make an agreement with Apple Corps before digital distribution can begin.</p>
<p>&#8220;EMI want something we&#8217;re not prepared to give &#8216;em. It&#8217;s between EMI and The Beatles I think - what else is new?,&#8221; McCartney stated to the BBC. &#8220;Last word I got back was it&#8217;s stalled at the moment. But I really hope it will happen because I think it should.&#8221;</p>
<p><a href="http://www.appleinsider.com/articles/08/11/25/talks_to_bring_the_beatles_to_itunes_break_down.html">AppleInsider has received word</a> from EMI who said that the company is &#8220;working hard to secure [an] agreement with Apple Corps to make the Beatles&#8217; catalogue available in digital form&#8221; but added &#8220;the various parties involved have been unable to reach agreement.&#8221;</p>
<p>EMI hopes to make progress &#8220;soon.&#8221;</p>

			<content:encoded><![CDATA[<p>As previously reported by many in the Apple web, the New York Judge in the <em>IBM v. Papermaster</em> suit ordered IBM to post a three-million dollar bond to cover any potential damages that Papermaster may suffer if IBM fails to prove that the injunction was appropriate.  Specifically, as reported by <a href="http://www.edibleapple.com/ibm-ordered-to-post-3-million-dollar-bond-in-papermaster-case-papermaster-responds-to-complaint/" target="_blank">Edible Apple</a>:<br />

In the on-going saga between I.B.M and Mark Papermaster over his decision to work for Apple, a Ditrict Judge in New York has recently ordered that I.B.M post a 3 million dollar bond in the event that it’s later decided that the preliminary injunction initiated by I.B.M was without merit. </em></p>
<p>Late last week, IBM posted the appropriate bond.  Also of interest, just like Psystar (but hopefully with actual merit, unlike Psystar), Papermaster countersued IBM right back.  Papermaster alleges:</p>
<ul>
<li>The employment agreement signed by Papermaster precludes him from working for any direct or business enterprise competitor with IBM.  Papermaster argues that Apple fails on both counts; it is not a direct competitor and it is not a business enterprise company, but rather a consumer products company.</i>
<li>The agreement is overly broad as its prohibition lasts for one year which is unreasonably long in the fast-paced world of technology.</li>
<li>The agreement provides that it shall be governed by the laws of New York, but Papermaster actually works in Texas and would work for Apple in California and those two states are not friendly to such agreements.</li>
